On October 11, 2009, California Assembly Bill 1020 was signed into State law. This bill adds Section 116064.2 to the California Health and Safety Code. This new section incorporates provisions of the Federal Virginia Graeme Baker (VGB) Act into California State law and is intended to prevent suction drain entrapments and drowning. The compliance deadline for the California Law is July 1, 2010. |

San Bernardino, Riverside, Los Angeles, and Orange Counties Environmental Health Departments have released their own requirements for this law and are more stringent than the State and Federal requirements. Most of the required work to achieve compliance will require plans, permits, Health Department approval and inspections. We can advise and provide detailed proposals for all circumstances. If work is performed without approval and permits, the county health inspectors will shut down the pool. The pool will not be re-opened until a permit has been approved and work has been completed and inspected. The permit processing times this year may likely reach six weeks or longer to receive approval. The work required in order to achieve compliance in California, requires the performing contractor to possess the C-53 Swimming Pool Contractor license, issued by the Contractors State License Board. We encourage all property owners and managers to check the license and status of any contractor at the CSLB website. |

We understand that the current economy has made it very difficult for swimming pool and spa upgrades and will do all we can to help mitigate costs. We have been working with the counties, manufacturers, suppliers, and others involved with compliance and have a very thorough understanding of this Act. We will explore all the options available to you and supply you with a proposal listing all of these options at no cost.
Failure to bring your pool into compliance also exposes you to possible federal fines. Performing work without a permit may result in months of shut down by the Health Department as well. We encourage you to take the time to complete this process correctly in order to avoid injuries, substantial fines, additional costs, and periods of shut down time. |
